Artkery Terms of Service

These terms define the governing laws and contractual parties based on the user's residence:

  • Users residing in South Korea enter into a contract with Artkery Korea, governed by South Korean law.
  • Users residing outside of South Korea enter into a contract with WithMeLive Inc., based in Delaware, USA, and governed by the laws of the State of Delaware, excluding its conflict of law rules.

Local laws in the user's jurisdiction may take precedence and limit certain terms. Unless prohibited by law, the conditions in these terms remain valid.

Chapter 1: Introduction

Welcome to the Artkery platform ("platform"). These terms outline the legal conditions for using Artkery's services, including digital artbook creation, art transactions, custom product sales, and related services. By using the platform, you are deemed to agree to these terms, which are periodically updated. The latest update was on January 18, 2024.

Chapter 2: General Provisions

  1. Effectiveness of Terms: These terms apply to all services provided through the Artkery website (www.artkery.com) and the platform.
  2. Service-Specific Terms: Certain services may be subject to additional terms or operational policies, which will be specified on the respective service pages.
  3. Amendments: Artkery reserves the right to amend these terms in compliance with applicable laws. Amended terms become effective upon notification. Changes that negatively impact users will be notified at least 30 days in advance.

Chapter 3: User Obligations

  1. Accurate Information: Users must provide accurate and up-to-date information during registration and update it promptly if changes occur.
  2. Account Security: Users are responsible for maintaining the security of their accounts. Artkery is not liable for damages caused by password leakage.
  3. Prohibited Activities:
    • Identity theft, false information provision, or uploading illegal content.
    • Disrupting platform operations or attempting to disable technical safeguards.
    • Infringing on others' rights or engaging in illegal activities.

Chapter 4: Digital Content Services

  1. Digital Artbook Creation:
    • Users must own the copyright or have appropriate licenses for all content (e.g., photos, images, text, graphics) uploaded to create digital artbooks.
    • Users are fully responsible for any legal disputes arising from content that violates copyright, portrait rights, or other intellectual property rights.
    • Artkery reserves the right to reject, delete, or restrict content deemed illegal or inappropriate.
  2. Copyright Protection:
    • Artkery employs reasonable technical measures to prevent illegal copying or misuse of digital content.
    • However, Artkery is not responsible for damages caused by illegal use, duplication, or misuse outside the platform. Users are encouraged to adopt additional copyright protection measures as needed.
  3. Usage Rights:
    • Digital content provided through the platform is non-exclusive and non-transferable.
    • Users are prohibited from using digital content for commercial purposes or redistributing it to third parties without authorization.
  4. Refund Policy:
    • Due to the nature of digital content, refunds are not provided after the service has commenced.
    • Users should carefully review content descriptions and samples (if available) before purchasing.
  5. Content Retention After Account Termination:
    • Even after account termination, content uploaded to the platform (e.g., digital artbooks, images, descriptions) may remain to ensure seamless service operation.
    • Users can request content deletion separately through customer service.
  6. Service Suspension and Refunds:
    • Registered digital artbooks and content are available online but may be temporarily suspended or terminated due to technical issues or force majeure (e.g., server outages, natural disasters).
    • If users have paid for a one-year publication fee for digital artbooks, any unused period will be refunded on a pro-rata basis.
    • Refund requests for service suspension must be submitted to customer service, and Artkery will finalize the refund if the service cannot be resumed.
    • Service interruptions or terminations will be notified in advance where possible; in unavoidable situations, post-notifications will be provided.
